Terms of Use
These terms of use govern the use of the Heimster platform by searchers, providers, and other registered users. They describe the key rights, obligations, and responsibilities when using our platform.
1. Scope and contracting parties
These terms of use govern the relationship between Heimster AG, Zug, Switzerland, operating under the brand heimster, and the individuals or companies who use Heimster.
By registering or using the platform you accept these terms. Deviating terms of users apply only if we expressly agree to them in writing.
2. Services provided by Heimster
Heimster is a real estate platform for searching, presenting and connecting contacts around rental and other properties. Its features include in particular listings, applications, document sharing, viewings, messages and supporting AI functions.
Heimster provides the technical platform and is not a party to rental, purchase or management contracts between users. Users remain responsible for listing content, profile details and interactions between users.
Supplementary rules, service descriptions, security requirements or publication guidelines may apply to individual features, user groups or product areas. Such supplementary provisions become, where published or indicated in the product, part of the usage relationship and take precedence over the general terms of use for the respective area in the event of conflicts.
3. Accounts and permitted use
Certain features require a user account. Information provided at registration and during use must be true, complete and up to date. Access credentials must be kept confidential.
We may suspend, restrict or delete accounts where there are concrete indications of misuse, security risks or breaches of these terms.
Users are themselves responsible for providing the technical requirements for using the platform, adequately protecting their access credentials and backing up their own data to the extent required under the circumstances.
For certain features, user groups or risk situations, Heimster may require additional security measures, such as verifications, proof of identity, restrictions on certain actions or, in future, enhanced authentication procedures.
4. Obligations of users
On Heimster the following are in particular prohibited:
- false, misleading or fraudulent information
- listings for unavailable or unauthorised properties
- forged documents or identity details
- discriminatory, unlawful or abusive content
- spam, scraping, crawling, automated data retrieval and reverse engineering without our prior written consent, as well as any other interference with the security, integrity or availability of the platform
Providers are responsible for the lawfulness and currency of their listings. Seekers are responsible for the authenticity and lawfulness of their application documents.
Anyone who makes content, documents, contact details or other information available via Heimster warrants that they are authorised to do so and comply with the applicable data protection, personality, copyright and fair competition rules. This also applies where third-party data is transmitted, for example of reference persons, flatmates, employees or clients.
Anyone who captures, imports or manages third-party contact, prospect or applicant data via Heimster, or contacts such persons through the platform – for example via CRM, lead form or matching functions – is responsible for having the required legal basis or consent and for complying with the applicable data protection and competition rules, in particular regarding unsolicited advertising. Heimster only provides the technical infrastructure for this.
Providers must in particular ensure that they are authorised to publish and market the property in question, that listings contain no misleading statements and that offered properties are promptly updated or deactivated once let or no longer available.
Seekers must in particular ensure that their profile and application details are correct and that uploaded documents are genuine, current and permissible for the respective purpose.
Where users share documents, application materials or other information with other users, they decide themselves which content is shared. Heimster provides the technical sharing infrastructure for this but assumes no responsibility for how authorised recipients further use information lawfully disclosed to them outside our sphere of influence, unless this is excluded by mandatory law.
5. Connected accounts (email and calendar)
Providers may optionally connect their own Microsoft 365 or Google Workspace account to Heimster via the respective provider's OAuth procedure, in order to read, assign and reply to emails from their own address directly within Heimster and to synchronise appointments with their own calendar.
- Providers may only connect accounts they are authorised to use and must comply with the terms of use of their email/calendar provider.
- The respective provider is responsible for messages sent from Heimster via the connected account and for the appointment invitations triggered thereby.
- Heimster accesses the connected account only to the extent granted (OAuth permissions) and exclusively to provide these functions. Details are set out in the privacy policy.
- The connection can be disconnected in Heimster at any time, or access can be revoked in the security settings of the respective Microsoft or Google account.
The availability and scope of these integrations depend on the services and requirements of the respective providers and may change.
6. AI-assisted features
Heimster may provide AI-based support functions for text, search and image editing. Such results are suggestions and must be reviewed on your own responsibility before use.
Anyone who uses AI functions is responsible for ensuring that the underlying inputs and the results subsequently used are lawful and do not infringe the rights of third parties.
For AI-assisted media, descriptions or other content, responsibility for factual accuracy, transparency and legal admissibility always remains with the respective user. Heimster may restrict, label or subject the use of individual AI functions to additional requirements where this is warranted for legal, ethical, quality-related or security-related reasons.
7. Applications, communication and viewings
Where Heimster provides functions for applications, document sharing, messages, scheduling or viewings, these serve to structure the organisation of contact between users. However, Heimster owes neither the conclusion of an application nor the conclusion of a rental or purchase contract nor the actual carrying out of a scheduled appointment.
Providers decide on their own responsibility which applications they review, which additional documents they request and whom they invite to interviews or viewings. Seekers decide on their own responsibility whether and to what extent they respond to enquiries or provide further information.
Messages, shares, status changes and appointment details on the platform may constitute process-supporting indications but do not replace legally binding declarations beyond what is actually binding under applicable law or by express declaration of the parties involved.
8. Rights to content
All rights to the platform, including software, design, trademarks, database structure, user interface and product logic, remain with Heimster or the respective licensors.
Where users post or transmit content such as listing texts, images, documents, profile information or other materials via the platform, they grant Heimster a non-exclusive, geographically unlimited right, limited to the duration of use, to store, process, display, technically prepare and make available this content within the platform and, where necessary for operation, to pass it on to affiliated technical service providers or authorised recipients.
This grant of rights serves exclusively the operation, security, moderation, quality assurance and further development of Heimster and generally ends upon deletion of the relevant content, subject to statutory retention obligations or legitimate interests in documenting processes.
9. Liability and availability
We strive for the highest possible availability of the platform but cannot guarantee uninterrupted or error-free operation. Maintenance, security measures or disruptions may temporarily limit availability.
To the extent permitted by law, Heimster is liable only for damage caused intentionally or through gross negligence. We assume no liability for content of other users, contracts concluded between users or the unreviewed use of AI-generated content.
Also excluded, to the extent permitted by law, is liability for indirect damage, lost profit, data loss, business interruptions, availability outages due to force majeure, cyberattacks, disruptions by third-party providers, network failures or official measures. Mandatory statutory grounds for liability remain reserved.
In particular, Heimster gives no warranty that listings, applications, user profiles, verifications, ratings, messages or appointment details are at all times complete, current, correct or suitable for a particular purpose. Users make their economic and legal decisions on their own responsibility.
10. Indemnification
If a user causes a breach of applicable law or of the rights of third parties through their content, information, documents, communications or other use of the platform, Heimster may require that user to indemnify Heimster against resulting third-party claims, official proceedings, costs and reasonable defence costs, to the extent the user is responsible for the breach.
11. Termination, changes and final provisions
Users may generally close their account at any time. We may amend these terms of use where this is necessary for objective reasons, for example in the case of product changes, new features or legal requirements.
In the event of serious or repeated breaches, we may suspend accounts without notice or permanently exclude them. This applies in particular in cases of suspected fraud, forged documents, manipulation of the platform, discriminatory or unlawful content and security-relevant incidents.
Notices relating to the usage relationship may be made in text form, in particular by email, in-app notice or via comparable electronic channels, to the extent legally permissible.
Heimster is entitled to transfer rights and obligations arising from the usage relationship to an affiliated company or a legal successor, provided that the legitimate interests of users are not unreasonably impaired thereby.
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zug, unless mandatory law provides otherwise.
